Affiliate program

By signing up for the Foxize Cloud Affiliate Program, you indicate your acceptance of this Agreement and its terms and conditions.

Foxize Cloud reserves the right to approve or reject ANY Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Application for the Affiliate program.

Terms and Conditions
1. Commissions
  • As a Foxize Cloud affiliate you will earn a monthly commission of 10% (VAT included) for each paying customer you refer and for the entire duration of your subscription.
  • Payments will be made quarterly and will be sent during the first weeks of January, April, July and October.
  • It is necessary that you have accumulated at least €15 to proceed with the payment of the commissions.
  • The commission will be calculated only once we have received the full payment from the client.
  • In the case of any refunds issued for any reason, including, but not limited to, fraud and where such refunds are incurred through no fault of our own, we may contact you to arrange a refund of any related fees.
  • You will not be entitled to a Commission on any purchases you make yourself, and Foxize Cloud reserves the right to review any fraudulent transactions and review final payments to you as it deems appropriate.
2. Completion

Your membership application and your status in the Program may be suspended or terminated for any of the following reasons:

  • Our program does not allow self-referrals. Our goal is for you to recommend Foxize Cloud to other people.
  • Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
  • Communications that discriminate or encourage discrimination on any basis, including, but not limited to, race, national origin, gender, gender identity, sexual orientation, age, or disability.
  • Communications that contain sexually explicit or violent material, or that encourage violent or abusive behavior.
  • Communications that contain defamatory conduct or that violate the intellectual property rights of a third party or that harm Foxize Cloud any other.
  • Illegal communications or communications that encourage illegal conduct.
  • Spamming (mass email, mass newsgroup posting, etc.).
  • Detection of abuse or any suspicious behavior will result in the immediate termination of your account.
  • Violation of intellectual property rights. Foxize reserves the right to require license agreements from those who use the Foxize Cloud trademarks to protect their intellectual property rights.
  • Self-referrals, fraudulent transactions, suspected affiliate fraud.
3. Affiliate links
  • You can use graphic and text links both on your website and in your email messages. You can also advertise the Foxize Cloud site in online and offline classified ads, magazines and newspapers.
  • You may use the graphics and text we provide, or you may create your own as long as they are deemed appropriate under the Terms and do not violate the terms described in Term 2.
4. Liability

Foxize Cloud will not be liable for consequential or incidental damages (loss of income, commissions) due to affiliate tracking failure, loss of database files, or any result of attempted damage to the Program and/or our site(s) ( s) web.

We make no express or implied warranties with respect to the Program and/or the memberships or products sold by Foxize Cloud. We make no claim that the operation of the Program and/or our website(s) is error-free and we will not be liable for any interruptions or errors.

5. Modification of these terms

We may modify any of the terms specified in this Agreement, at any time and in our sole discretion, by posting a change notice or a new agreement on our website, and we may do so without notice to you.

6. Protection of personal data

In accordance with the provisions of Regulation (EU) 2016/679, of April 27, 2016 (RGPD), Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and related regulations on protection of personal data, we inform you that the personal data provided by the affiliate will be treated under the responsibility of Foxize School, SL. to manage compliance with these terms and will be kept with the strictest security and confidentiality while there is a contractual relationship between both parties. The data will not be communicated to third parties, except legal obligation.

Likewise, the affiliate can exercise the rights of access, rectification, portability and deletion of their data, and those of limitation and opposition to their treatment by writing to the address of Foxize School, S.L., at C / Diputación, 305 Piso 3º Door 2, 08009 Barcelona.

7. Governing Law, Jurisdiction, and Attorneys' Fees

This Agreement shall be governed by and construed in accordance with the laws of Spain. Any dispute arising out of or in any way related to this Agreement shall be resolved exclusively in the courts located in Barcelona. In the event of a dispute to enforce any provision of this Agreement, the prevailing party shall be entitled to recover its costs and fees, including reasonable legal fees, from the other party.
